Many IRA home energy rebate programs (HOMES and HEEHRA) require that HVAC work be performed to code and properly permitted to qualify for rebates. An unpermitted heat pump installation may disqualify you from federal and state rebates worth $2,000โ$8,000. Get the permit first.
Why Heat Pump Permits Are More Complex
A heat pump replacement looks similar to a standard AC replacement โ outdoor unit, indoor air handler, refrigerant lines. But several factors make the permit picture more complicated:
- Electrical panel upgrades: Many older homes have 100-amp panels that need upgrading to 200-amp service to support a heat pump plus other electrification loads. A panel upgrade requires a separate electrical permit and may trigger a utility inspection.
- Backup heat source: Most air-source heat pumps in cold climates include auxiliary or emergency electric resistance heat strips. The additional electrical load must be reflected in the permit application and inspected.
- Gas furnace removal: When replacing a gas furnace + AC with an all-electric heat pump, the disconnected gas line must be properly capped and the flue sealed โ both are inspected items.
- Geothermal heat pumps: Ground-source systems require additional permits for the ground loop installation (typically a plumbing or excavation permit in addition to mechanical and electrical).

IRA Incentives and Permit Requirements
The Inflation Reduction Act created two major heat pump incentive programs: the 25C federal tax credit (up to $2,000 for qualifying heat pump installations) and the HEEHRA rebate program (up to $8,000 for income-qualified households, administered by states).
Both programs have a code compliance requirement โ the work must be performed to current energy and building codes. A permitted and inspected installation is the clearest documentation of code compliance. An unpermitted installation creates risk when claiming these credits:
- State HEEHRA rebate administrators may require permit documentation as part of the rebate application
- If your tax return is audited and the heat pump installation was unpermitted, the IRS may question whether the installation met qualifying standards
State-Specific Notes
Kentucky: Heat pump replacements follow the same rules as all Kentucky HVAC permits โ permit required statewide, homeowner exemption available once per 5 years. Florida: Florida's building code specifically addresses heat pump installations. The statewide energy code requires heat pumps to meet minimum efficiency standards (currently SEER2 14 or higher for most systems). Installers must include equipment efficiency documentation in the permit application.
California: California has the most complex heat pump permitting environment, primarily due to Title 24 energy compliance documentation requirements. New heat pump installations often require a HERS (Home Energy Rating System) verification report in addition to the mechanical and electrical permits.
